يبدأ سريان العقد اعتبارا من تاريخ تسليم الموقع للمستثمر بموجب محضر رسمي على أن لا تزيد عن شهر من تاريخ العقد ويتم تسليم الموقع للمستثمر غيابياً في حال عدم حضوره لاستلام الموقع في الموعد المحدد.​

في حال إنسحاب مقدم أعلى عطاء يتم مصادرة الضمان البنكي المقدم منه ويتم التفاوض مع مقدم العطاء الثاني لرفع قيمة عطاءه.​

يتم ترسية المزايدة على مقدم أعلى عطاء إذا كانت قيمة العطاء مناسبة ومستوفي لجميع الشروط والمستندات المطلوبة.​

لا يمكن تغيير النشاط المذكور في العقد نهائياً حسب نص المادة التاسعة من لائحة التصرف بالعقارات البلدية.​
